A Preliminary Notice must usually be provided to the notified party before work begins on a construction project, or within a certain time frame from when materials and/or materials are first furnished. In some states, these are called “Notice of Contract,” “Notice to Owner,” “Notice of Non-Payment,” “Notice of Lien Rights,” “20-Day Notice,” and “Notice of Lease.”
A Notice of Intent to Lien must usually be provided to the notified party after work is complete, but a certain amount of days before filing a mechanics lien.
Requirements are Strict!
Notice requirements are different from state to state, and project to project. And can be very strict, requiring specific form requirements, pre-established font sizes and styles, and special delivery or service.
